B. Personal Data

For the purposes indicated in this Privacy Notice, FORZA GLOBAL may collect your personal data in various ways: when the information is provided directly by you; when collected at fairs and exhibitions; when you visit the FORZA GLOBAL website; when our sales, technical service, design engineers, administration and finance accredited personnel make a visit or consultation in person or by telephone; when you quote by printed or electronic means, or use the services and products offered by FORZA GLOBAL via telephone, face-to-face, online and when we obtain information through means other than those indicated above and that are permitted by applicable laws.

The personal data obtained by the aforementioned means are:

1. Identification data of contacts, users or managers: name (s), surname (s), address, title, company, work telephone number, cell phone, company, email, username and password of access to the Forza Global Solutions portal via the “login” of the intranet with FORZA GLOBAL customers.

2. Financial contact details of the Company: name of the legal representative, finance or payment representative, telephone, email, source account number, date of operation (in case of online transactions).

3. Billing data: name or business name, RFC, notification email, tax address, boarding addresses, shipment reception personnel.

C. Sensitive Personal Data

Sensitive personal data is the personal data that affects the most intimate sphere of its owner, or whose improper use may give rise to discrimination or entail a serious risk to it. In particular, those who may reveal aspects such as racial or ethnic origin, present and future state of health, genetic information, religious, philosophical and moral beliefs, trade union membership, political opinions, sexual preferences are considered sensitive. In case of making any query, receiving a technical visit or carrying out any commercial operation, with any of our representatives, the sensitive personal data that we will request you to provide us will be those related to the performance of our services and products, which will be used only to provide you with a better service and meet your specific needs.

D. Purpose and Processing of Personal Information

Purposes that give rise to the legal relationship and are necessary for the provision of services and products:

1. The information of both the legal person or the natural person you provide us will be used by FORZA GLOBAL to provide the services and products that you request or that are part of a quotation, development of a preliminary draft or a project, or a purchase that you have made and mentioning some non-limiting examples such as: request for brochures, request for manuals, request for quotes, sending information for the development of a project that includes electronic drawings, plans, photos, specifications, as well as satisfaction surveys, supplier numbers, numbers and access codes to information exchange systems (EDI), affiliation to a training program, maintenance program, purchase of a service or item within the product portfolio of FORZA GLOBAL.

2. FORZA GLOBAL may use the business or personal information you provide to us to provide you with a better service and, where appropriate, identify your requirements, specifications, the case or object to be served, preferences and specifications to provide you with the solution that best suits you or your company.

Purposes that do NOT give rise to the legal relationship nor are they necessary for the provision of service:

1. Likewise, we can use the information to offer you technical and commercial bulletins, news, invitation to special events, information and invitation on participations in fairs and exhibitions, sending of promotions, information of special services, satisfaction surveys, the above being carried out in person, via social networks or online.

E. Limitation on Use or Disclosure of Personal Information

At any time you can express your refusal to process the purposes that do not give rise to the legal relationship or are necessary for the provision of services and products, or the revocation of the consent you have granted us to the processing of your personal data, by means of a request that must be presented in writing to the Commercial Department at the following address: Camino Viejo a San Gaspar No. 8, Col. Miguel Hidalgo, Jiutepec, C.P. 62556, Morelos, Mexico, from 8:30 to 18:00 hours from Monday to Friday, or by email contacto@forzaglobal.com

Such request must contain at least the following: (i) Name of the Holder of the Personal or Business Data; (ii) Email to receive notifications; (iii) Documents proving their identity or, when appropriate, the legal representation of the holder; (iv) Clear and precise description of the personal data with respect to which it is sought to exercise the right and the right that is intended to exercise. (v) Any other element or document that facilitates the location of personal data. In the event that the application does not satisfy any of the requirements indicated above, the Commercial Department may require you within 5 days of receipt of the application to provide the elements or documents necessary to process it. You will have 10 days to meet the request, in case of not responding within this period, the corresponding request will be not presented.

The deadlines for attention will be a maximum of 20 days from the date on which the request is received to inform you of the determination adopted, so that, if appropriate, it becomes effective within 15 days of the issuance of the response. In order to protect your confidentiality, FORZA GLOBAL will send the response to your request to the email address you have provided for this purpose and will keep it available to the applicant at the address indicated in the previous paragraph.

F. Of the Exercise of the Rights of Access, Rectification, Cancellation and Opposition.

The access, rectification, cancellation or opposition regarding the information provided to FORZA GLOBAL indicated in the Federal Law on Protection of Personal Data held by Individuals, may do so by delivery of the request addressed to FORZA GLOBAL, in terms of the provisions of subsection E. above, which will be answered in the terms indicated therein.

G. The use of warranties.

The use of warranties will depend on each product, the time granted for each warranty varies depending on the type of product and the contractual stipulations that have been agreed in each case in a particular way.

The warranties will be applied in the terms and conditions agreed by the parties in each contract concluded, providing quality and security in the service provided by FORZA GLOBAL.

The warranty of the protections is between 8 and 18 months once the implementation under the requirements requested and validated in the client plant.

For the application of the warranty in the protections, the following points must be met:

1. They must be perfectly stored.

2. They must not have contact with the ground or any other surface outside of what is its function.

3. They must be placed correctly, according to the training given at the beginning of the online implementation.

4. Not be mutilated and/or altered by operating personnel.

5. They must not be exposed to the sun.

6. They must not be exposed to the rain.

During removal, avoid pulling and stressing that may cause the detachment of any component, this should be done according to the training given at the beginning, during and completion of the online implementation.

H. Control and Security of Personal Information.

FORZA GLOBAL is committed to taking the necessary measures to protect the information collected, using security technologies and control procedures in the access, use or disclosure of your business or personal information without authorization, for example, by storing the business or personal information provided on servers located in Data Centers that have limited access controls.

However, no security or data transmission system which the company does control and/or is dependent on the Internet can guarantee that it is completely secure.

I. Electronic media and cookies.

In the event that you use electronic means in relation to your personal data, cookies will be generated in order to provide you with a better service.

Cookies are small pieces of information that are sent by the website to your browser.

On this website, the Contact section includes a form through which it is possible to directly send a message with the corresponding subject (Complaint, Suggestion, Jobs) and addressed to the recipient you deem appropriate (Sales, Purchases, Human Resources, General).

Once your message has been sent, FORZA GLOBAL undertakes to issue a response within 10 working days of receipt of the message. This response will be addressed to the person indicated in the “Your name” field and sent to the “Your email” mail. It is possible that, for the purposes of an adequate understanding and a correct treatment of the information, in said response it is requested that you complement the original message with documents, evidence, references, audiovisual material or any other format, which allows to continue with the requested procedure. If after 10 working days no favourable response has been received, the original application shall be treated as not submitted.

FORZA GLOBAL may at any time update this privacy notice. In the event that there are substantial changes to this notice, we will communicate it through the websites indicated in subsection A of this Privacy Notice. Therefore, we suggest that you periodically visit this privacy notice to be aware of any updates.

On the other hand, we inform you that this communication has been addressed only to the recipient of this and constitutes confidential information of our company for all purposes of the law. If you are not the recipient, we ask you to destroy this communication and we would appreciate it for letting us know to the same email from which the information was issued.
